Lawyer Harish Salve said the Supreme Court on Thursday said that it might intervene with regulations to protect the functioning of the court, but "there is nothing" government to control the media.
"The idea that the media is out of regulation is completely wrong. However, it is
also true that the (media) are outside the regulation of the Government. There is nothing in the government control the media, "he told the five-judge Constitution bench to consider framing guidelines for the media to cover the court proceedings.
He told the bench headed by Chairman of the SH Kapadia that the Government of the Republic is "suspect" when it comes to the media, and "it is the court who should do it."
"If the court finds that a particular publication would affect the regular conduct of the court (the court) to do whatever necessary to protect the functioning of the judiciary," Salve submitted before the bench also includes justices DK Jain, SS Nijjar, Ranjan Prakash Desai and JS Khehar.
"In essence, the court record is entitled to defend the judicial system works," he said, adding that "the court record has been recognized that enjoy the power to punish for contempt."
"It is clear that if it is necessary to injunct publication in order to ensure a fair trial. This right is available to the court record. In order to prevent the publication of evidence was considered valid by the court to conduct a study on" Salve said.
Suggesting the right balance between freedom of expression, vis-a-vis the press freedom under Article 19 and the right to life and liberty under Article 21 of the Constitution, he said the rights under Article 19 of the individual and can not be assimilated into the "class rights".

"Court Reporting exchanges must be intelligent and purely factual. Each report, which indicates that the court has aspersions on any person or functionary during the exchange, is simply wrong. It may also be biased."
